THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ABDULLAH SHAREEF, ALSO KNOWN AS ABDULLAH H. SHAREEF, DEFENDANT-APPELLANT.


PRESENT:

Respondent having moved to dismiss the appeal taken herein from a judgment of the Genesee County Court, rendered October 11, 2017, on the ground that appellant has failed to perfect timely the appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, and there being no opposition thereto,

It is hereby ORDERED that the notice of appeal filed in the Genesee County Clerk's Office on October 17, 2017, which inaccurately lists Transfer Case No. 2015-1228, shall be treated as valid as to the judgment rendered October 11, 2017, pursuant to CPL 460.10 (6), and

It is further ORDERED that the motion is granted and the appeal is dismissed.
