PEOPLE v. SEUMANU (ROPATI)


Withdrawal of counsel allowed by order

Attorney Mark D. Greenberg's “Motion to Withdraw as Counsel of Record,” filed May 2, 2019, is granted in part and denied in part as follows. The motion is granted as to the appointment as habeas corpus counsel. Accordingly, the portion of the order filed on July 8, 2009, appointing Attorney Mark D. Greenberg to represent condemned inmate Ropati Seumanu for habeas corpus proceedings related to the above automatic appeal is hereby vacated. Pending further order of the court, the motion to withdraw is denied as to the appointment as counsel for executive clemency proceedings.

The “Joint Motion for Appointment as Counsel of Record,” filed by Attorneys Michael R. Snedeker and Lisa R. Short on May 2, 2019, is denied as follows. The request for appointment as counsel for habeas corpus proceedings is denied without prejudice to counsel filing a new motion in the superior court. The request for appointment as counsel for executive clemency proceedings is denied.

Corrigan, J., was recused and did not participate.
