Motion by the District Attorney of Kings County to dismiss an appeal by defendant from an order denying his application to require the District Attorney to preserve and keep intact the grand jury minutes on file in his office pertaining to the indictment on which appellant was convicted. The motion is granted on the ground that the order is not appealable. (Code Crim. Pro., § 517.)
