Opinion

THE PEOPLE, Plaintiff and Respondent, v. TROY JAMES SAVOY, Defendant and Appellant. B206931 California Court of Appeal, Second District, Sixth Division September 29, 2008

NOT TO BE PUBLISHED

Superior Court County of Santa Barbara Super. Ct. No. 1228235, Rogelio R. Flores, Judge

Richard Lennon, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

GILBERT, P.J.

Troy James Savoy appeals an order revoking his probation and sentencing him to 16 months' imprisonment.

On May 30, 2007, Savoy received advice of and waived his constitutional rights, and pleaded nolo contendere to possession of methamphetamine. (Health & Saf. Code, § 11377, subd. (a).) The trial court suspended imposition of sentence and granted Savoy 36 months' probation pursuant to the drug treatment program of Penal Code section 1210.1 ("Proposition 36").

On February 6, 2008, the trial court found Savoy in violation of probation. Savoy admitted that he did not attend a drug treatment program as directed, that he tested positive for drug use, and that he violated the terms and conditions of probation. The trial court imposed a low-term sentence of 16 months' imprisonment, imposed fees and fines, and awarded Savoy 99 days' presentence custody credits. Savoy requested a certificate of probable cause to challenge his nolo contendere plea. The trial court denied the certificate.

We appointed counsel to represent Savoy in this appeal. After counsel's examination of the record, he filed an opening brief raising no issues.

On August 5, 2008, we advised Savoy that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have not received a response.

We have reviewed the entire record and are satisfied that Savoy's attorney has fully complied with his responsibilities and that no arguable issue exists. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

We concur: YEGAN, J., COFFEE, J.
