Appellate Division of the Supreme Court of New York, Second Department
Mar 16, 2010
71 A.D.3d 922 (N.Y. App. Div. 2010)

Opinion

No. 2008-05335.

March 16, 2010.

Appeal by the defendant from a judgment of the County Court, Westchester County (Cacace, J.), rendered May 14, 2008, convicting her of offering a false instrument for filing in the first degree, upon her plea of guilty, and imposing sentence.

Mark J. Fitzmaurice, White Plains, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Laurie Sapakoff, Richard Longworth Hecht, and Anthony J. Servino of counsel), for respondent.

Before: Rivera, J.P., Florio, Dickerson, Belen and Roman, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
