People v. Robinson

Appellate Division of the Supreme Court of New York, Second Department
Nov 16, 1970
35 A.D.2d 826 (N.Y. App. Div. 1970)

Opinion

November 16, 1970

Appeal by defendant from a judgment of the County Court, Orange County, rendered December 22, 1969, convicting her of criminal possession of a dangerous drug in the fifth degree, upon a plea of guilty, and sentencing her to probation for five years. Case remitted to the County Court for a hearing and a determination on the propriety of defendant's plea of guilty. In the interim the appeal will be held in abeyance. The County Court should have made an inquiry to satisfy itself that defendant was in fact guilty and that defendant understood the nature of the charges and the consequences of the plea of guilty ( People v. Beasley, 25 N.Y.2d 483). Rabin, Acting P.J., Latham, Kleinfeld, Brennan and Benjamin, JJ., concur.
