People v. Roache

Appellate Division of the Supreme Court of New York, Second Department
Nov 7, 1994
209 A.D.2d 451 (N.Y. App. Div. 1994)

Opinion

November 7, 1994

Appeal from the County Court, Orange County (Berry, J.).

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see, Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 631; cf., People v. Gonzalez, 47 N.Y.2d 606). Moreover, the issues raised by the defendant in his supplemental pro se brief either were waived by the defendant when he pleaded guilty, or they are frivolous. Sullivan, J.P., Santucci, Joy and Krausman, JJ., concur.
