PEOPLE of the State of Michigan, Plaintiff-Appellee, v. Timothy Treshaen RICE, Defendant-Appellant.


Order

On order of the Court, the application for leave to appeal the February 4, 2021 order of the Court of Appeals is considered. We DIRECT the Wayne County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order. The prosecutor shall pay particular attention to the defendant's claim in Issue II that trial counsel rendered constitutionally ineffective assistance for failing to interview and call at trial a res gestae witness, Joshua Ragland, and the defendant's claim in Issue III that he was denied the effective assistance of appellate counsel for failing to obtain an affidavit from Mr. Ragland in support of a motion to remand.

The application for leave to appeal remains pending.
