On order of the Court, the motion for immediate consideration is considered and it is GRANTED. The application for leave to appeal from the April 21, 2000 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should now be reviewed by this Court.

Kelly, J., would direct the Court of Appeals to grant the motion to remand for an evidentiary hearing.
