People v. Porter

Appellate Division of the Supreme Court of New York, Second Department
Dec 10, 1937
253 App. Div. 734 (N.Y. App. Div. 1937)

Opinion

December 10, 1937.

Judgment of the County Court of Suffolk county convicting the appellant of the crime of grand larceny in the second degree reversed on the law, indictment dismissed and bail exonerated. Appeal from orders dismissed. Assuming that the indictment is sufficient, the evidence does not support the verdict on any count. Furthermore, there is no proof of criminal intent. Hagarty, Davis, Adel, Taylor and Close, JJ., concur.
