Order filed: holding for new lead case

This court has granted and held the above-captioned cases pending disposition of related issues in People v. Buycks (S231765). Upon further consideration, the court designates Buycks the lead case and defers further action in People v. Derritt (S237538) and Driver (Tommy) on H.C. (S232329) pending consideration and disposition of related issues in Buycks.

In addition, the court designates Guiomar (John) on H.C. (S238888) the lead case concerning whether a Penal Code section 1320.5 enhancement must be dismissed if the felony for which the defendant was on bail, and failed to appear, is later reduced to a misdemeanor under Proposition 47. Petitioner is directed to serve and file an opening brief on or before February 20, 2017. Respondent is directed to serve and file an answer brief on or before March 6, 2017. Petitioner may serve and file a reply brief on or before March 15, 2017.

The court continues to defer all further action in the matters of People v. Eandi (S229305), People v. Enquist (S238804), People v. Ferguson (S233596), People v. Jewkes (S236685), People v. Perez (S229046), People v. Strickland (S233933), People v. Sulitswalley (S238539), pending consideration and disposition of related issues in Guiomar or pending further order of the court. (Cal. Rules of Court, rule 8.512(d)(2).)
