Appellant Angela Marie Pelligra pled guilty to one felony count of escape while in custody for a felony conviction (Pen. Code, § 4532). Pursuant to the plea bargain, the trial court sentenced Pelligra to the upper prison term of three years. Pelligra was ordered to pay a restitution fine and granted applicable custody credits.

Pelligras appointed appellate counsel has filed an opening brief which summarizes the pertinent facts, raises no issues, and requests this court independently to review the record. (People v . Wende (1979) 25 Cal.3d 436, 158 Cal. Rptr. 839, 600 P.2d 1071.) The opening brief also includes the declaration of appellate counsel indicating that Pelligra was advised she could file her own brief with this court. By letter of December 5, 2002, we invited Pelligra to submit additional briefing. To date, she has not done so.

After independent review of the record, we have concluded no other reasonably arguable legal or factual argument exists.

The judgment is otherwise affirmed.
