Opinion

April 28, 1943.

Appeal from Broome County Court.


There is no question in the record of the guilt of the defendants. The judgment of conviction is sustained by the overwhelming weight of the evidence. Attention is called to the error in the charge in connection with reasonable doubt and as to section 393 of the Code of Criminal Procedure. There were some errors but they may be disregarded under section 542 of the Code of Criminal Procedure. Judgment of conviction affirmed. All concur.
