An order of this Court having been entered on April 07, 2022 (M-1037) granting defendant leave to prosecute, as a poor person, the appeal taken from the judgment of the Supreme Court, Bronx County, rendered on or about May 06, 2021, and assigning Caprice R. Jenerson, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal; and assigned counsel having moved to be relieved as such counsel, or in the alternative, to dismiss the appeal without prejudice, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon proof of service of the within motion on defendant at his last known address and an explanation of further attempts made to locate defendant.
