Upon remittitur from the Court of Appeals (19 N.Y.3d 368, –––N.Y.S.2d ––––, ––– N.E.2d ––––, 2012 N.Y. Slip Op. 04278 [2012] ), appeal from order, Supreme Court, Bronx County (Denis J. Boyle, J.), entered on or about January 29, 2009, which enlarged the conditions of defendant's sentence of probation to permit searches of defendant's home, concomitant with home visits by the Department of Probation, unanimously dismissed, pursuant to the opinion of the Court of Appeals.
