People v. Oviedo

Appellate Division of the Supreme Court of New York, Second Department
Jul 12, 1993
195 A.D.2d 528 (N.Y. App. Div. 1993)

Opinion

July 12, 1993

Appeal from the Supreme Court, Queens County (Savarese, J.).

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see, Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 631; cf., People v. Gonzalez, 47 N.Y.2d 606). Moreover, appellate review of the issues raised by the defendant's supplemental pro se brief were effectively waived by her as part of her plea bargain (see, People v Callahan, 80 N.Y.2d 273; People v. Seaberg, 74 N.Y.2d 1). Bracken, J.P., Balletta, Eiber, O'Brien and Pizzuto, JJ., concur.
