DECISION & ORDER ON MOTION

Motion by defendant to deem the motion filed with the Appellate Term as of May 18, 2012, requesting an extension of time to take an appeal pursuant to CPL 460.30, from a judgment of conviction of the District Court of Suffolk County, First District, rendered May 16, 2011.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and it is deemed filed with the Appellate Term as of May 18, 2012; and it is further,

ORDERED that the motion for an extension of time to take an appeal pursuant to

CLR 460.30 is granted and defendant's moving papers are deemed to constitute a timely notice of appeal.
