MOTION DECISION

An order of this Court having been entered on March 12, 2020 (M-651) granting defendant leave to prosecute, as a poor person, the appeal taken from a judgment of the Supreme Court, New York County, rendered on or about December 05, 2018, and assigning Christina Swarns, Esq., predecessor to Caprice R. Jernerson, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal; and assigned counsel having moved to be relieved as such counsel, or in the alternative, to dismiss the appeal without prejudice, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon a showing of counsel's efforts to obtain an official record of defendant's death.
