Now, upon reading and filing the statement of Adam J. Noto dated October 20, 2015, the notice of motion with proof of service thereof, the statement of Daniel Gross, Esq. dated December 21, 2015, the affirmation of Andre A.Vitale, Esq. dated December 17, 2015, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the pro se notice of appeal dated October 7, 2015, which was served upon the Monroe County District Attorney's Office on December 7, 2015, is hereby deemed timely served, and
It is further ORDERED that Adam J. Noto is hereby directed to file the pro se notice of appeal dated October 7, 2015 at the Monroe County Clerk's Office in accordance with CPL 460.10 on or before January 27, 2016.
