Defendant having moved pursuant to CPL 460.30 to extend the time to move for leave to appeal from an order of Supreme Court, Monroe County dated October 20, 2014 and entered October 29, 2014,

Now, upon reading and filing the affidavit of Andre Norwood sworn to January 7, 2015, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary.
