Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered August 6, 1970 on resentence, upon a conviction of manslaughter in the first degree, on his plea of guilty in 1967. Judgment affirmed. Appellant's present incarceration is pursuant to a judgment of conviction based on acts committed after his release from prison following service of time under a prior judgment of conviction rendered in 1954, which was later reversed. His present sentence is as a first felony offender and is in no way involved with the time previously served. Rabin, P.J., Hopkins, Munder, Martuscello and Christ, JJ., concur.
