It is ordered that the opinion filed in this case on December 20, 2005, be modified as follows:

The second sentence of the second full paragraph on page 14 of the opinion [134 Cal.App.4th 1508, advance opinion, 3d par.], beginning with the words “This is because” and ending with the words “possession of another” shall be deleted, and the following sentence inserted in its place:

“For example, one can broker a sale of a controlled substance that is within the exclusive possession of another.”

This modification does not change the judgment.

Appellant’s petition for rehearing is denied.
