It is ordered that the opinion filed herein on April 17, 2006, be modified in the following particulars:

The word “appointed� should be changed to “retained� in the following four locations:

1. Page 8, in the last line, reading: “defendant’s request to relieve appointed counsel . . . .�

2. Page 9, in the first sentence, reading: “Under that standard, the defendant has the right to discharge appointed counsel with or without cause.�

3. Page 9, line 4, reading: “to relieve appointed counsel must be granted

. . . .�

4. Page 10, last paragraph, line 2, reading: right to effective assistance of counsel by denying his motion to relieve appointed . . . .�

This modification does not effect a change in judgment.
