THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. MELVIN J. MOORE, JR., DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved to withdraw his motion to hold in abeyance his writ of error coram nobis motion seeking to vacate the order of this Court entered September 29, 2006, affirming a judgment of Monroe County Court, rendered April 25, 2003, and for other relief,

Now, upon reading and filing the affidavit of Melvin Moore sworn to October 18, 2018, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion to withdraw is dismissed, and

It is further ORDERED that the motion to amend a pending coram nobis application is denied without prejudice to any future application.
