Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Onondaga County Court, rendered October 2, 2012,

Now, upon reading and filing the affidavit of Shakeem Moore, sworn to May 19, 2014, the notice of motion with proof of service thereof, the statement of James P. Maxwell, Esq. dated May 30, 2014, the statement of J. Scott Porter, Esq. dated May 28, 2014, and the statements of Shakeem Moore dated May 28, 2014 and June 7, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion dismissed as unnecessary.
