Opinion

THE PEOPLE, Plaintiff and Respondent, v. CHRISTOPHER GLENN MICHAEL, Defendant and Appellant. C055142 California Court of Appeal, Third District, El Dorado November 8, 2007

NOT TO BE PUBLISHED

Super. Ct. No. S06CRF0084

BLEASE, Acting P. J.

On April 26, 2006, based upon defendant Christopher Glenn Michael’s having cashed several forged checks in local businesses, he entered a negotiated settlement whereby he pled no contest to three counts of second degree burglary, one count of false personation, and admitted service of a prior conviction in exchange for the dismissal of other counts and a stipulated sentence of six years. It was further agreed that defendant was to be released on his own recognizance and if, as directed, he returned to court on May 8, 2006, for sentencing, the court would reduce his sentence to two years eight months.

Defendant failed to appear on May 8, 2006, but was eventually arrested in November 2006. On March 5, 2007, the court imposed the agreed upon six-year term.

We appointed counsel to represent defendant on appeal. Counsel filed an opening brief that sets forth the facts of the case and requests this court to review the record and determine whether there are any arguable issues on appeal. (People v. Wende (1979) 25 Cal.3d 436.) Defendant was advised by counsel of the right to file a supplemental brief within 30 days of the date of filing of the opening brief. More than 30 days elapsed, and we received no communication from defendant. Having undertaken an examination of the entire record, we find no arguable error that would result in a disposition more favorable to defendant.

The judgment is affirmed.

We concur: DAVIS, J., NICHOLSON, J.
