Transferred to Court of Appeal, Second Appellate District, Division Five, after hold

The above-captioned matter is transferred to the Court of Appeal, Second Appellate District, Division Five, with directions to vacate its decision and rule on defendant's motion for limited remand. (Cal. Rules of Court, rule 8.528(d).) If the motion is denied, the Court of Appeal shall reinstate the judgment, and any party may petition for review on the former or new grounds. If the motion is granted, the Court of Appeal shall set a time limit for the proceedings on remand. If the proceedings on remand do not result in withdrawal of the appeal, the Court of Appeal may reinstate its judgment with any necessary modifications, and any party may then seek review on the former or new grounds.
