Motion to dismiss the appeal taken by defendant McMahon granted and said appeal dismissed upon the ground that the criminal prosecution as to said defendant has abated by reason of his death (see People v Prunty, 46 N.Y.2d 1014; People v Mintz, 20 N.Y.2d 753, 770).
