People v. McElveen

Appellate Division of the Supreme Court of New York, Second Department
Nov 28, 1983
97 A.D.2d 852 (N.Y. App. Div. 1983)

Opinion

November 28, 1983

Appeal by defendant from a judgment of the Supreme Court, Queens County (Agresta, J.), rendered February 26, 1980, convicting him of robbery in the second degree, upon his plea of guilty, and imposing sentence. Judgment affirmed. We have reviewed the record and agree with defendant's assigned counsel that there are no meritorious issues that could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted. (See Anders v California, 386 U.S. 738; People v Paige, 54 A.D.2d 631; cf. People v Gonzalez, 47 N.Y.2d 606.) Bracken, J.P., Brown, Niehoff and Boyers, JJ., concur.
