Opinion

THE PEOPLE, Plaintiff and Respondent, v. LOGAN JOSHUA MCDONOUGH, Defendant and Appellant. H034359 California Court of Appeal, Sixth District October 23, 2009

NOT TO BE PUBLISHED

Santa Cruz County Super. Ct. No. F17377

Mihara, J.

The Santa Cruz County District Attorney filed an information charging appellant Logan Joshua McDonough with robbery (Pen. Code, § 211). The information was later amended to add one count of grand theft (Pen. Code, § 487, subd. (c)) and one count of assault by means of force likely to cause great bodily injury (Pen. Code, § 245, subd. (a)(1)). Pursuant to a negotiated agreement, appellant pleaded no contest to the grand theft and assault charges. The trial court placed appellant on probation on condition that he serve 180 days in county jail, and dismissed the robbery charge. Appellant was given credit for 19 days of custody. The trial court denied appellant’s motion for custody credits for the 31 days that he spent in the electronic monitoring program. Appellant has filed a timely appeal from the order imposing probation.

I. Statement of Facts

On October 9, 2008, appellant stole Jacob Hunter’s property. He also aided and abetted another individual who hit Hunter in the head with a baseball bat.

II. Discussion

Appointed appellate counsel has filed an opening brief which states the case and the facts but raises no issues. Appellant was notified of his right to submit written argument on his own behalf, but he has failed to avail himself of the opportunity. Pursuant to People v. Wende (1979) 25 Cal.3d 436, we have reviewed the entire record and have concluded that there are no arguable issues on appeal.

III. Disposition

The order is affirmed.

WE CONCUR: Elia, Acting P. J., McAdams, J.
