Petitioner's request to expand the issues on review or transfer for reconsideration is granted in part and denied in part as follows:

The request to transfer for reconsideration is granted. The above-captioned matter is transferred to the Court of Appeal, Fifth Appellate District, with directions to vacate its decision and reconsider the cause in light of Senate Bill No. 775 (Stats. 2021, ch. 551) and People v. Lewis (2021) 11 Cal.5th 952. (Cal. Rules of Court, rule 8.528(d).)

The request to expand the issues on review is denied as moot.
