People v. Mason

Appellate Division of the Supreme Court of New York, First Department
Mar 9, 2004
5 A.D.3d 178 (N.Y. App. Div. 2004)

Opinion

3075.

Decided March 9, 2004.

Judgment, Supreme Court, Bronx County (Michael Sonberg, J.), rendered June 13, 2002, convicting defendant, upon his plea of guilty, of sexual abuse in the first degree, and sentencing him to a term of 2 years, unanimously affirmed.

Tracy Siligmueller, for Respondent.

Victor Schurr, for Defendant-Appellant.

Before: Andrias, J.P., Saxe, Sullivan, Gonzalez, JJ.

The court properly exercised its discretion in denying defendant's application to withdraw his guilty plea ( see People v. Frederick, 45 N.Y.2d 520). The court accorded defendant a full opportunity to present his claims, all of which were contradicted by the plea allocution record. The record further establishes that defendant received effective assistance of counsel in connection with his plea ( see People v. Ford, 86 N.Y.2d 397, 404).

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
