ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

RICHLI, J.

The petition for rehearing is denied. The opinion filed in this matter on January 22, 2008, is modified as follows:

1. At page 5 of the opinion, the fifth sentence of the last paragraph, which states “Guevara told Deputy Harris that his last name was Torres” is replaced with the following:

Either Garibay or Guevara lied to police officers about his name.

2. On page 15, the second sentence of the second full paragraph is modified to read as follows:

There is some evidence that either Garibay or Guevara gave a false name to police officers when they were detained.

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
