People of Michigan v. Allan Gene-Reeder Martin Jr

LC No. 1996-504416-FC

Douglas B. Shapiro Presiding Judge, David H. Sawyer, Mark T. Boonstra Judges

ORDER

The "motion to show cause for failure to produce certificate" is DENIED. It is the appellant's responsibility to secure the filing of the stenographer's certificate. See MCR 7.210(B); IOP 7.217(A)-1. Appellant's counsel should contact, and work with, the trial or district courts to identify the responsible court reporter(s) and make a concerted effort to secure the filing of the necessary stenographer's certificate(s) from the responsible court reporter(s). In the alternative, if counsel is unable to secure the filing of the requested transcripts, she is responsible for taking steps to settle the record. MCR 7.210(B)(2). The Clerk of the Court shall place this case on the involuntary dismissal docket without further notice to the parties after 35 days unless appellant's counsel files stenographer's certificate for the outstanding hearing dates or files proof that she has filed the necessary motion in the trial court to initiate the process of settling the record.
