People v. Madrigal

California Court of Appeals, Fourth District, First Division

No. D053793 (Cal. Ct. App. Jul. 2, 2009)

Opinion

THE PEOPLE, Plaintiff and Respondent, v. GUSTAVO MADRIGAL, Defendant and Appellant. D053793 California Court of Appeal, Fourth District, First Division July 2, 2009

NOT TO BE PUBLISHED

APPEAL from a judgment of the Superior Court of San Diego County No. SCN249245, Daniel B. Goldstein, Judge.

AARON, J.

Gustavo Madrigal entered a negotiated guilty plea to attempted grand theft from the person of another (Pen. Code, §§ 487, subd. (c), 664). The court placed him on three years' probation. Madrigal appeals. We affirm.

BACKGROUND

On August 1, 2008, Madrigal unlawfully attempted to take property from the person of Francisco Leon.

DISCUSSION

Appointed appellate counsel has filed a brief summarizing the facts and proceedings below. Counsel presents no argument for reversal, but asks this court to review the record for error as mandated by People v. Wende (1979) 25 Cal.3d 436. Pursuant to Anders v. California (1967) 386 U.S. 738, counsel lists as possible, but not arguable, issues: whether the guilty plea is constitutionally valid and whether Madrigal was properly advised of the immigration consequences of his plea.

We granted Madrigal permission to file a brief on his own behalf. The order sent to Madrigal was returned to this court as undeliverable and Madrigal has not responded. A review of the record pursuant to People v. Wende, supra, 25 Cal.3d 436 and Anders v. California, supra, 386 U.S. 738, including the possible issues listed, has disclosed no reasonably arguable appellate issues. Madrigal has been competently represented by counsel on this appeal.

DISPOSITION

The judgment is affirmed.

WE CONCUR: McDonald, Acting P. J., IRION, J.
