Now, upon reading and filing the affidavit of Mark A. Lorenz sworn to March 6, 2012, the notice of motion with proof of service thereof, the affirmation of Roseann B. MacKechnie, Esq. dated March 23, 2012, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered October 3, 2011 is hereby amended by striking therefrom the date November 2, 2011 and inserting in place thereof the date May 16, 2012 (see People v Sher, 35 NY2d 310).
