Judgment, Supreme Court, New York County (Felicia A. Mennin, J.), rendered May 8, 2018, convicting defendant, upon his plea of guilty, of attempted criminal sale of a controlled substance in the third degree, and sentencing him, as a second felony drug offender previously convicted of a violent felony, to a term of 3½ years, unanimously affirmed.

Defendant was correctly adjudicated a second felony drug offender previously convicted of a violent felony, and he did not meet his burden of establishing that his 2004 conviction was unconstitutionally obtained (see CPL 400.21[7][b] ; People v. Harris, 61 N.Y.2d 9, 15, 471 N.Y.S.2d 61, 459 N.E.2d 170 [1983] ). The minutes of defendant's 2004 plea proceeding reveal that he pleaded guilty to assault in the second degree knowingly, intelligently, and voluntarily (see id. at 19–21, 471 N.Y.S.2d 61, 459 N.E.2d 170 ; see also Boykin v. Alabama, 395 U.S. 238, 243, 89 S.Ct. 1709, 23 L.Ed.2d 274 [1969] ). Although the court did not enumerate all of defendant's rights during the plea colloquy, the record demonstrates that defendant "intelligently and understandingly rejected his constitutional rights" after consulting with counsel in order to take advantage of the negotiated preindictment plea offer (see People v. Conceicao, 26 N.Y.3d 375, 383, 23 N.Y.S.3d 124, 44 N.E.3d 199 [2015] ; People v. Cepeda, 195 A.D.3d 477, 144 N.Y.S.3d 859 [1st Dept. 2021], lv denied 37 N.Y.3d 991, 152 N.Y.S.3d 406, 174 N.E.3d 346 [2021] ).
