ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING; NO CHANGE IN JUDGMENT

IKOLA, J.

It is ordered that the opinion filed herein on July 23, 2007, be modified as follows:

On page 2, first sentence of the last paragraph, the word “car” is changed to “cars”so the sentence reads: “Montemayor, defendant, and another man (Antonio Macias) got out of the cars.”

The petition for rehearing is DENIED.

There is no change in the judgment.
