Withdrawal of counsel allowed by order

Good cause appearing, the application of appointed appellate counsel for permission to withdraw as attorney of record for appellant Herminio Serna, filed August 10, 2017 (supplemental proof of service filed Aug. 21, 2017), is granted.

The order appointing Edward J. Horowitz as appellate counsel of record for appellant Herminio Serna, filed June 26, 2002, is hereby vacated.

Upon request of appellant for appointment of counsel, Conrad Petermann, previously appointed to represent appellant Herminio Serna for habeas corpus/executive clemency proceedings related to the above automatic appeal now pending in this court, is hereby appointed to also represent appellant Herminio Serna for the direct automatic appeal.

Horowitz is hereby directed to deliver to Petermann, within 30 days from the filing of this order, all case transcripts, case files, appellate work product, trial files, 60-day status reports, and all related materials that he has obtained from appellant Herminio Serna or from Serna's trial counsel, paralegals, or service providers, or from any other source.

The date for appointed counsel to file the appellant's opening brief on behalf of Herminio Serna is hereby vacated; the court will set a new due date for that filing in due course.
