ORDER MODIFYING OPINION

AND DENYING PETITION FOR

REHEARING; NO CHANGE IN

JUDGMENT

It is hereby ordered that the opinion filed on March 12, 2012, be modified as follows.

On page 4, fourth paragraph, first sentence, insert the phrase "and while the prosecutor remained in the courtroom," between the words "hearing" and "defendant." As modified, the sentence will read:

After the court heard argument from counsel at the sentencing hearing, and while the prosecutor remained in the courtroom, defendant asked the court "to delay [his] sentencing as far as for conflict of interest and communication," "[o]n regards with my attorney."

The modification does not change the judgment.

The petition for rehearing is DENIED.
