People of Michigan v. Gregory DeShawn League

LC No. 01-000879-01-FC

Kirsten Frank Kelly, Noah P. Hood Judges

ORDER

Anica Letica Presiding Judge

The delayed application for leave to appeal is DENIED because defendant has failed to establish that the trial court erred in denying the motion for relief from judgment. Although the trial court erred by holding that "[ineffective assistance of counsel can take the form of a failure to call witnesses or present other evidence only if the failure deprives the defendant of a substantial defense," see People v Allen,____ Mich____; 953 N.W.2d 197 (2021), such error was harmless because the trial court nevertheless reached the correct ultimate outcome, see People v Moorman, 331 Mich.App. 481, 490; 952 N.W.2d 597 (2020) ("This Court will not reverse when the trial court reaches the right result for the wrong reason.").
