Appellant having moved to compel the District Attorney to produce a written transcript of People's hearing Exhibit #2 to be used for an appeal from a judgment of the Onondaga County Court rendered April 5, 2016, and other relief,

Now, upon reading and filing the affidavit of Michael James Layou sworn to November 9, 2016, the notice of motion with proof of service thereof, the affirmation of James P. Maxwell, Esq. dated November 18, 2016, and due deliberation having been had thereon,
