The above-entitled matter is transferred to the Court of Appeal for the Fourth Appellate District, Division Three, with directions to vacate its decision and to reconsider the cause in light of People v. Brendlin (2006) 38 Cal.4th 1107, 45 Cal.Rptr.3d 50, 136 P.3d 845 and People v. Saunders (2006) 38 Cal.4th 1129, 45 Cal.Rptr.3d 66, 136 P.3d 859. (Cal. Rules of Court, rule 29.3(d).)
