People v. Lake

Appellate Division of the Supreme Court of New York, Second Department
Jun 24, 1996
228 A.D.2d 699 (N.Y. App. Div. 1996)

Opinion

June 24, 1996

Appeal from the County Court, Orange County, Berry, J., Byrne, J.

Ordered that the judgment and amended judgment are affirmed.

Contrary to the defendant's contention, we find that the jury verdict was not against the weight of the evidence ( see, CPL 470.15). Moreover, the defendant's sentence was not excessive ( People v. Suitte, 90 A.D.2d 80).

The defendant's remaining contentions are either unpreserved for appellate review, without merit, or do not require reversal. Bracken, J.P., Thompson, Krausman and Goldstein, JJ., concur.
