ORDER TO SHOW CAUSE

Appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered August 14, 2015. By decision and order on motion dated October 28, 2016, the appeal was stricken from this court's appeals calendar and general calendar, as the minutes that the District Court reviewed in determining appellant's CPL 30.30 motion had not been made part of the record on appeal. Those minutes have still not been provided to this court.

Now, on the court's own motion, it is

ORDERED that the parties are directed to show cause before this court why the appeal should or should not be dismissed as abandoned by filing an affidavit or affirmation on that issue with the Clerk of this court on or before August 4, 2017; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties by regular mail.
