People of Michigan v. Jacob Langston-Porter Labelle

LC No. 18-000596-FC

ORDER

Douglas B. Shapiro, Judge, acting under MCR 7.211(C)(7) and MCR 7.211(E)(2), orders:

Defendant-appellant moves for reconsideration of the Court order vacating his conviction and remanding for further proceedings as the Court failed to consider defendant's request that upon remand the case be reassigned to a new judge. The prosecution has elected not to file a response. After review of the record, including the post-trial proceedings, and the factors set forth in People v Walker, 504 Mich. 267; 934 N.W.2d 727 (2019) the Court GRANTS the motion for reconsideration and orders that on remand the case be reassigned to a different judge.
