10-26-2016

PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. RAYMOND LEE KYLE, Defendant-Appellant.

Order

153165 & (15)(16)(21)(23) Robert P. Young, Jr., Chief Justice Stephen J. Markman Brian K. Zahra Bridget M. McCormack David F. Viviano Richard H. Bernstein Joan L. Larsen, Justices COA: 330203
Berrien CC: 02-400252-FC

On order of the Court, the motion to file supplemental authority is GRANTED to the extent that this Court's May 16, 2016 order in People v Swain (Docket No. 150994) is accepted as supplemental authority. The application for leave to appeal the December 29, 2015 order of the Court of Appeals is considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D). The motion for stay of proceedings, the motion to remand, and the motion to amend are DENIED.

I, Larry S. Royster, Clerk of the Michigan Supreme Court, certify that the foregoing is a true and complete copy of the order entered at the direction of the Court.
