ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

THE COURT:

It is ordered that the nonpublished opinion filed herein on December 27, 2011, be modified as follows:

On page 17, the final sentence of the second paragraph, which reads, “Defendant clearly earned the sentence imposed upon him, ” shall be deleted, making the final sentence of the opinion (before disposition): “Regardless of our own views on how he might best be rehabilitated or fittingly punished, the setting of penalties is for the Legislature.”

This change does not effect a change in the judgment.

The petition for rehearing is denied.
