Appellant having moved for a writ of error coram nobis vacating the order of this Court entered December 30, 1999 affirming a judgment of Erie County Court, rendered March 5, 1997,

Now, upon reading and filing the affidavits of John Moore sworn to November 7, 2016 and February 8, 2017, the notice of motion with proof of service thereof, the affidavit of David A. Heraty, Esq. sworn to December 5, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.
