THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. JOANNE ARMOUR ALSO KNOWN AS JOANNE CHRISTOPHER, DEFENDANT-APPELLANT.


PRESENT:

Appellant having moved for access to her pre-sentence investigation report relating to the judgment of the Supreme Court, Monroe County, rendered September 12, 2014, and for other relief,

Now, upon reading and filing the affidavits of Joanne Armour sworn to May 27, 2015, the notices of motion with proof of service thereof, the statement of Daniel Gross, Esq. dated June 24, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion seeking access to the pre-sentence investigation report is denied, and

It is further ORDERED that the motion seeking access to transcripts relating to the appeal taken from the judgment of Supreme Court, Monroe County, rendered September 12, 2014 is dismissed as premature.

Memorandum: A motion for disclosure of the pre-sentence investigation report should be made to the sentencing court (see CPL 390.50; People v Tisdale, 238 AD2d 964 [1997]).
